Special Meeting
March 10, 2016 10:00 A.M.
Special Meeting was called to order at 10:00 a.m. by Mayor Brian Linin, with Commissioner Gwen Mai, Commissioner Gary Farris and Vice-Mayor Annette Fairbanks responding to roll call. Commissioner John Garcia was reported absent.
Also present were Rich Simon – Director of Public Works, Brian James – Fire Chief, Alex Weis – Code Enforcement, Mary Volk – City Clerk, Gerry Bieker – City Manager and Jake Kling – City Attorney.
- Resolution 1475: Emergency Action Pursuant to Section 7-612 – Gerry stated, we have experienced an unfortunate incident. The owner of 1006 Caldwell was found deceased and property contains biohazard material and is in bad shape. We want to proceed with cleanup of property as quickly as possible to eliminate any hazard coming from the property. Alex showed Commission pictures of property. Gerry stated, issues are cats, roaches, human feces and the structure itself. Code requires Commission to authorize approval to address immediate concern on property. Commissioner Mai asked, does she have any family members? Gerry stated, a niece then a couple sisters who have not had any contact with her. We will contact everyone we are aware of that could have an interest in property so they know how we are proceeding. Mayor Linin asked, are we demolishing property? Jake stated, the property will eventually move toward demolition but at this point resolution is to contain and eliminate hazards. The demolition will be a later date when we determine if there are current owners. This process is two-fold: containment then demolition. Under the City Code sited in resolution, the Commission is authorized to delegate responsibilities to contain hazards. This gives staff authority to talk to State offices to eliminate hazards. Vice-Mayor Fairbanks asked, how many cats are there? Jake stated, we do not know final number but for sure, upwards of 10 which are all unhealthy and cats we do not want lose in City for health reasons. Brian stated, I contacted Emergency Management and KDHE to determine proper way to dispose of biohazards. Jake stated, the house is a danger for anyone that goes on property. Gerry stated, we cannot mitigate the problem if we do not eliminate the structure. ON A MOTION by Vice-Mayor Fairbanks to approve Resolution 1475: Emergency Action Pursuant to Section 7-612 for property at 1006 Caldwell seconded by Commissioner Mai. MOTION carried on a VOTE of 4-0.
ADJOURNMENT WAS HAD ON A MOTION by Vice-Mayor Fairbanks, seconded by Commissioner Mai. MOTION carried by unanimous VOTE, meeting adjourned at 10:13 a.m.
