RESOLUTION NO. 1475
A RESOLUTION granting emergency action pursuant to Section 7-612 of the Code of the City of Goodland immediate hazard to the public at large hereby granting permission and directing all code enforcement officers and their representatives to include fire, police, animal control and the like, access to the property located at 1006 Caldwell, Goodland, Kansas, for the purpose of removing all domestic animals, containing any and all infestation by fumigation, and follow any directions provided by state agencies concerning hazardous waste and dangerous material
WHEREAS, on the 9th day of March, 2016, the Goodland Police Department and emergency personnel responded to a 911 call stating that the owner of the home was found deceased inside the residence; upon arriving at the residence and witnessing the interior of the home it was deemed to be unsafe and hazardous; and
WHEREAS, at an emergency meeting of the City Commission held on the 10th day of March, 2016, at 10:00 A.M. in the City Commission Chambers in the Goodland City Building the following resolutions were unanimously adopted:
RESOLVED, that the property located at 1006 Caldwell, Goodland, Kansas, is deemed an immediate hazard to the health, safety and well-being of the public at large;
FURTHER RESOLVED, that Kathy Schermerhorn, Animal Control Officer for the City of Goodland, is authorized to enter and have access to the property for the purpose of removing all domestic animals found on and within the property and take said animals to the veterinary clinic for medical examination and evaluation and is further authorized to carry out recommendations of the examining veterinarian concerning the care and/or euthanization of said animals;
FURTHER RESOLVED, that all code enforcement officers and their representatives are authorized to carry out any steps required to contain or eradicate any infestation by means of, but not limited to, fumigation of the property with the intent of containing or eradicating the same;
FUTHER RESOLVED, that all code enforcement officers and their representatives are authorized to communicate with state agencies and follow recommendations and procedures in disposing of any hazardous waste and dangerous material found on the property;
FURTHER RESOLVED, that the City of Goodland and its officers are authorized to suspend any of the utilities provided to the property including electricity, water and the like;
FURTHER RESOLVED, that all city officials and officers are authorized to seek out and communicate with any party having a potential ownership interest in said property concerning actions taken under this resolution and any actions going forward involving the property.
